Legal notice
- The Products offered on the Website comply with the applicable Italian legislation. Reda Industries S.r.l. (also in short “Seller” and/or “Lanieri”) respects and protects the consumer in terms of the legal guarantee of conformity and is liable for any defect that occurs within 2 (two) years from delivery of the goods pursuant to art. 130 of the Consumer Code.
- With regard to exercising this right, consumer goods are presumed to conform to the contract if:
- the product has the characteristics normally expected of goods of the same type;
- the goods conform to the description provided by the seller and possess the qualities presented to the consumer by the seller through samples or models;
- the goods possess the qualities that can be reasonably expected by the consumer, taking into account the nature of the goods and, where applicable, the statements made about them by the seller through advertising, sponsors and product information sheets, or by the manufacturer or its agent or representative, including labelling;
- the products are suitable for the specific purpose intended by the consumer, in accordance with what was presented at the time of purchase, provided that this purpose was made known to the seller at the time the contract was stipulated and accepted by the seller, even implicitly.
- The following do not fall under the definition of “lack of conformity”:
- personal comfort preferences when wearing the garment;
- damage caused by cuts, burns, tears, abrasions, stains or halos caused by direct and/or indirect actions of the customer;
- wear of the item or accessory;
- loss of closure buttons;
- zipper breakage during use due to mechanical jamming;
- In accordance with Article 132 of the Italian Consumer Code, the buyer forfeits all rights if the lack of conformity is not reported to the seller within 2 months from the date the defect was discovered. To this end, the consumer must send written notification to the following address: Reda Industries S.r.l. – Via Robiolio no. 25, 13835 Valdilana (BI) – IT, or via email to: customercare@lanieri.com.
- In any case, unless proven otherwise, it is presumed that any lack of conformity manifested within 6 months of delivery of the product already existed at the time of delivery.
- In order to benefit from the legal guarantee, the consumer must provide proof of delivery of the product by the Seller, keeping for this purpose the proof of purchase (till receipt and/or sales receipt), or any other document that can certify the date of purchase (for example the credit card statement) and the date of delivery.
- If lack of conformity is confirmed, as defined in paragraph 2, the buyer may, in accordance with Article 130 of the Italian Consumer Code, request – at no additional cost – either the repair or replacement of the product, a reduction in the purchase price, or the termination of the contract, unless the request is objectively impossible to fulfil or would be excessively costly for Reda Industries S.r.l.
- Once the request has been forwarded, the Seller will respond to the consumer within 7 (seven) working days of its receipt, indicating its willingness to proceed with the request, or explaining the reasons why it is unable to do so.
- Should Lanieri decide to accept the consumer's request, it must indicate the shipping or return methods of the goods as well as the expected timeframe for the return or replacement of the defective product, at no cost to the buyer (in Italy).
- If repair or replacement is impossible or excessively costly, or if Reda Industries fails to repair or replace the product within the agreed timeframe, or if the previous repair or replacement caused significant inconvenience to the buyer, the buyer may request either an appropriate reduction in price or the termination of the contract. In this case, the buyer must submit the request to Reda Industries S.r.l., which shall respond within 7 (seven) business days of receipt, indicating its willingness to proceed with the request or explaining the reasons why it is unable to do so.
- Should Lanieri accept the consumer's request, it must indicate the proposed price reduction or the methods of returning the defective goods in exchange for a full refund of the amount paid, for whose reimbursement the consumer will indicate the operating methods.
- In the case of made-to-measure goods, if the product is customised, but has a manufacturing defect or does not correspond to the agreed specifications (e.g. due to an error in the measurements or materials), the guarantee of conformity applies in an identical manner to other products. However, if the made-to-measure product complies with what was requested by the customer but does not meet the aesthetic or functional expectations of the consumer (for example, the design is not as intended), the guarantee does not apply, unless there are manufacturing defects.
- The Customer acknowledges that the garments covered by these general terms and conditions are tailor-made and/or customized and, therefore, pursuant to Article 59, letter c) of Legislative Decree No. 206/2005 (Italian Consumer Code), the right of withdrawal does not apply. It is understood that any subjective evaluations of the Customer regarding the aesthetic appreciation of the requested modifications shall not constitute a lack of conformity, provided that the garment complies with the characteristics, measurements, and specifications agreed in writing. The liability of Lanieri in the event of objective discrepancies with respect to what has been agreed remains unaffected.
- The legal guarantee referred to above does not apply in the event that the methods of purchase or other circumstances show with reasonable certainty that the purchase is not intended exclusively for private consumption. In this regard, by way of example only, it should be noted that the request for an invoice, with the indication of the relevant VAT number, suggests the professional purposes of the purchase, thus excluding the applicability of articles 128 et seq. of the Consumer Code.
